Acknowledgment of Risks

I, the undersigned, understand and acknowledge that participation in activities at Miniversal Kids Cafe may involve inherent, obvious and foreseeable risks and hazards, including but not limited to:

• Physical Activity: Risk of injury from falls, collisions with equipment or other participants, rough play, or improper use of equipment.

• Play Equipment: Potential for injury due to the nature of climbing structures, slides, soft play equipment, toys, and other recreational facilities.

• Interaction with Other Children: Potential slips, trips, falls, or other incidents occurring within play areas, seating areas, walkways, dining areas, entrances, bathrooms, or other parts of the venue.

• Surrounding Environment: Potential slips, trips, falls, or other incidents occurring within play areas, seating areas, walkways, dining areas, entrances, or other parts of the venue.

• Food Allergies: Risk of exposure to allergens despite our nut-free policy, including possible cross-contamination in shared spaces, as well as the risk of exposure to common illnesses in public environments.

While Miniversal Kids Cafe implements safety procedures, venue rules, routine maintenance, and staff supervision to help minimise risks, I understand and acknowledge that it is not possible to eliminate all risks associated with indoor recreational activities.

I acknowledge that participation at Miniversal Kids Cafe is undertaken entirely at my own risk and on behalf of any child or accompanying person attending with me. I accept full responsibility for the supervision, behaviour, and safety of all children in my care at all times while on the premises.

I further acknowledge that accompanying adults and elderly persons entering the venue also do so voluntarily and at their own risk.

By allowing participation at Miniversal Kids Cafe, I voluntarily assume all risks associated with attendance and participation, including the risk of serious injury, illness, permanent disability, or death, to the fullest extent permitted by law.

Release of Liability

In consideration of participation at Miniversal Kids Cafe, I, on behalf of myself, my child or children, accompanying persons, and our respective heirs, assigns, administrators, personal representatives, and next of kin, hereby release, waive, discharge, and agree not to bring any claim against Miniversal Kids Cafe, Miniversal Playcentre, its owners, directors, employees, contractors, or agents in relation to any liability, claims, demands, actions, losses, damages, costs, expenses, injuries, or causes of action arising out of or related to:

• participation in activities at the venue;

• use of the play equipment or facilities;

• attendance at the premises; or

• any injury, illness, damage, loss, or death sustained by myself, my child, accompanying persons, or personal property.

This waiver and release applies to the fullest extent permitted under the laws of New South Wales and Australia, including in relation to recreational activities conducted at the venue, except where liability cannot lawfully be excluded under applicable legislation, including the Australian Consumer Law.

Indemnity and Compensation

I agree to indemnify, defend, and hold harmless Miniversal Kids Cafe, Miniversal Playcentre, its owners, directors, employees, contractors, agents, and representatives (“Indemnified Parties”) from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including legal costs on a full indemnity basis) arising out of or in connection with:

• my participation or the participation of any child or accompanying person under my care;

• any breach of this Waiver, Rules, or Venue policies;

• any negligent, reckless, or intentional act or omission by myself, my child, or any person under my supervision;

• any misuse of equipment or facilities within the venue; or

• any injury, loss, or damage caused to any third party arising from my or my child’s conduct while on the premises.

I acknowledge that this indemnity applies to the fullest extent permitted by law, and is intended to cover all reasonable legal and associated costs incurred by Miniversal Kids Cafe as a result of claims connected to my or my child’s attendance or actions at the venue.

Medical Authorization

In the event of an accident, injury, or medical emergency involving myself or a child in my care, I authorise Miniversal Kids Cafe to seek medical treatment or emergency assistance if deemed reasonably necessary.

I understand that Miniversal Kids Cafe will make reasonable efforts to contact me or my nominated emergency contact as soon as practicable before or during the provision of medical assistance.

I acknowledge that any medical, ambulance, hospital, or associated costs incurred remain my sole responsibility.

Rules and Guidelines

I agree to follow all rules, safety requirements, signage, socks policies, and staff directions established by Miniversal Kids Cafe to help ensure the safety and enjoyment of all guests.

I acknowledge that children remain under the supervision and responsibility of their parent, legal guardian, or supervising adult at all times while at the venue.

I understand that unsafe behaviour, failure to follow venue rules, misuse of equipment, aggressive conduct, or failure to comply with staff directions may result in removal from the venue without refund.
